General Business Terms and Conditions

1. Introductory Provisions

• 1.1. These General Business Terms and Conditions (hereinafter referred to as GBTC) are governed by Act No. 40/1964 Coll., the Civil Code, as amended.  The headings and the structure of these GBTC are intended only to add clarity, and shall bear no significance for their interpretation and meaning.  Unless the context indicates otherwise, the following terms shall have the following meaning in these GBTC:
• 1.2. “Buyer” shall mean the client, customer;
• 1.3. “Seller” shall mean the corporation CLICK4SKY.com;
• 1.4. “Order” shall mean the purchase of an airplane ticket;
• 1.5. “Supply” shall mean the goods, service.
• 1.6. By accepting the General Business Terms and Conditions in the Internet Booking System, the Buyer confirms that he/she has acquainted himself/herself with the contents of these GBTC and that he/she accepts them.  A contractual relationship is established when a booking is made. Liability for defects in services is governed by the relevant provisions of the Civil Code, Act No. 40/1964 Coll., as amended.

2. Ownership of the performance shall transfer to the Buyer once he/she accepts it in a documented fashion (receives the electronic ticket).

3. Supply Conditions

• 3.1. The place of delivery of an airline ticket is the electronic delivery address specified by the Buyer in the Internet Booking System.
• 3.5. The Seller shall inform the Buyer in a timely manner about the performance having been provided.  A travel itinerary shall be delivered to the Buyer’s electronic address, summarizing all of the relevant information concerning the Supply.

4. Payment

• 4.1. Payment is always cashless, electronically in the Internet Booking System, and payment shall mean the crediting of the relevant amount to the Seller’s account.
• 4.2. Invoicing is not possible.

5. Price

The price of the ticket is inclusive of all of the costs related to the delivery and documented acceptance of the performance.  The price is final and fixed, and includes all taxes and fees.

6. Services Provided and Conditions of Carriage

CLICK4SKY.com only offers return tickets in economy class.
CLICK4SKY.com does not provide any of the services listed below, offered by the carrier České aerolinie a.s.:

• Carriage of unaccompanied minors;
• Carriage of animals;
• Carriage of goods;
• Carriage of unaccompanied baggage;
• Transit and transfer services.

CLICK4SKY.com does not provide any reduced rates or free or reward tickets.

The carrier of the passengers who have purchased tickets from CLICK4SKY.com is České aerolinie a.s. (Czech Airlines).  By consenting to the General Terms and Conditions, the Buyer consents to the carrier’s Conditions of Carriage.

7. Refund and Transfer of Rights

• 7.1. The price of tickets is non-refundable.  No change in routing, date of flight, name of the passenger, or an exchange of the entire ticket is possible.
• 7.2. No party shall be entitled to assign or otherwise transfer any rights or liabilities or a part thereof arising from the Order to a third party, unless the other party has provided its prior written consent to that assignment or transfer.

8. Queries, comments and complaints

8.1. Queries, comments and complaints stall be addressed to Click4Sky – Contacts.

9. Governing Law

9.1. Any disputes which may arise from an Order and in connection with it, which are not settled by the negotiations of the contractual parties, shall be decided according to the laws of the Czech Republic, by Czech courts of the relevant jurisdiction.

This document is a translation of the Czech version of the General Business Terms and Conditions.  The Czech version shall prevail over this English translation.
